Abstract
The right of being able to move freely, interpreted as the ownership of ones own body, is more than a right; it is the necessary condition for human life. Within certain limits, both criminals and those who are guilty of serious crimes are allowed to move following the jails rules. Nevertheless, this important right can be called into question by diseases, a state of mind altered by organic pathologies, alcohol and drugs or simply by ageing. Very often, over the past years, the physical reclusion of patients has been ordinarily practised inside residential structures and especially in psychiatric hospitals. This tendency to intern people, has many times been defined as a procedure for the good of the patient by those who should safeguard the individuals health. This dissertations aim is to demonstrate the existance of an health care without detention and consequently without the violation of human rights, where legal problems and ethical-code conflicts dont exist through: an in-depth examination of the role of psychiatry, the healtcare assistants professional evolution and his (or her) role in psychiatry and of reclusions
